The second panel will explore a myriad considerations entailed in selecting the preferred dispute resolution path, including the available forums; the law to applied in those forums; the legal and business goals to be achieved; and the collectability of any recovery. Attendees will be exposed to best practices for deciding when informal resolution, meditation, arbitration or court litigation presents the preferred dispute resolution path.

Litigating Efficiently Without Losing Leverage
During our third session, we will address practical litigation management, including discovery needs, budgeting, internal reporting, strategies for small cases vs. bet-the-company suits, and avoiding unnecessary cost. A key theme is being nimble and efficient. The panel will also discuss the strategic use of smaller attorney teams in mediations and how that contributes to efficient and effective representation. E-discovery will be a major component, because nearly all records are now digital. Early identification of key custodians, documents, and ESI sources streamlines collection, reduces cost, and ensures the most relevant information is captured.

After the Dispute: Appeals, Business Changes & Future Prevention
During our final session, we will cover what happens after the initial dispute is resolved, including post-trial motions, appeals, judgment enforcement and execution, confidentiality considerations, protection of sensitive financial information, and lessons learned. Discuss how businesses can adjust contracts, processes, and operational practices to help prevent future disputes. Looking back, analyze how bankruptcy risk should influence litigation strategy from the outset, including the likelihood of recovering on a judgment, whether sufficient assets will remain available to satisfy that judgment, and how those realities affect post-judgment collection efforts, settlement decisions, and longer-term business restructuring considerations.
