Shareholder Nicole A. Josephy's practice focuses on complex civil litigation, with a particular emphasis on insurance counseling and recovery. She represents corporate and individual policyholders throughout Florida in high-stakes insurance coverage disputes, handling matters involving commercial property losses, business interruption claims, professional liability issues, construction-related claims, and other complex coverage matters. She also has experience serving as coverage counsel in third-party liability matters, advising on coverage obligations, policy interpretation, reservation of rights, and insurers' duties to defend and indemnify. Nicole advises clients on policy interpretation, insurer obligations, coverage positions, and risk management considerations, providing strategic guidance from pre-suit analysis and negotiation through litigation and trial when necessary. Her experience also includes declaratory judgment actions, broker negligence claims, Civil Remedy Notices, complex settlement agreement enforcement actions, and first-party property insurance claims involving wind, flood, and water damage losses. She regularly represents clients in mediations, depositions, and evidentiary hearings and has handled appellate matters in complex civil litigation.
Before joining Flaster Greenberg in 2020, Nicole practiced at a South Florida boutique firm dedicated exclusively to insurance recovery litigation, representing policyholders in disputes against national and international insurers. Earlier in her career, she worked at Florida’s largest litigation-focused firm, where she handled a broad range of commercial and civil litigation matters and developed significant experience in construction litigation. She represented contractors, developers, design professionals, subcontractors, owners, and other industry stakeholders in construction defect and contract disputes, experience that now enhances her work on construction-related insurance claims and coverage issues.
Nicole’s combined background in insurance recovery, commercial litigation, and construction disputes allows her to provide clients with practical, informed counsel on complex coverage matters. She has been recognized as a Florida Rising Star in Insurance Recovery by Super Lawyers (2025) and serves on the Florida College of Coverage Counsel Conference Planning Committee.
