Defects, Damages, and Dollars: Decoding Coverage and Allocation in Construction Disputes

This session examines how courts, carriers, and policyholders navigate the boundaries of covered “property damage,” the timing of loss, and the evolving divide between ongoing operations and completed work. It delves into exclusions, related to design and engineering, continuous and progressive damages, and course of completion, including the often-overlooked impact of wrap-up programs on traditional coverage assumptions. The program unpacks why trigger and allocation frequently diverge between the duty to defend and the duty to indemnify, and how those differences drive litigation and settlement strategy. It also addresses the practical mechanics of allocation, including verdict forms, special interrogatories, and intervention. Finally, the session takes a focused look at allocation in the context of Duke v. Hoch and post-Coblentz disputes, where precision and foresight are paramount.
