Titled “The Legal Justification Claimed for Mayor Mamdani’s Housing Plan,” the article examines how existing rent control and stabilization laws, along with measures like COPA, could expand government influence over housing. Markind notes that rent freezes may render properties economically unviable and invite legal challenges, including Article 78 proceedings.
He further explores how prolonged freezes could reduce development, lead to property deterioration, and increase government intervention. Markind concludes that these strategies may face significant constitutional challenges, including potential takings claims, and could position New York City as a national testing ground for housing policy.
