Lynda Calderone and Kristyne Bullock, shareholders in the Intellectual Property and Litigation Practice Groups at Flaster Greenberg, will be presenters at the Association of Corporate Counsel – Greater Philadelphia Chapter’s (ACC GP) 10th Annual In-House Counsel Conference. The conference will take place on April 25th at the Pennsylvania Convention Center in Philadelphia, PA. Calderone and Bullock will participate in an intellectual property panel and will be joined by Scott B. Schwartz, General Counsel at Dansko.
Their program, titled “Intellectual Property Fight CIub: How to Be an IP Bully and How to Defeat One,” will take a look at current developments impacting certain aspects of aggressively-postured intellectual property litigation, focusing on current trends in cases involving non-practicing entity (NPE). The panelists will address the impact of recent US jurisprudence, including the TC Heartland Sweeteners and Alice/Mayo decisions, on US NPE patent litigation. They will explore how NPEs, chased out of US jurisdictions by unfavorable case law, are increasingly using the procedural mechanics of European jurisdictions to leverage their legal positions, making Europe a new area in which NPEs may enforce, and actions proposed in Europe to attempt to address this trend. Additionally, the panel will examine trademark “bullying” litigation strategies designed to create and ensure strong branding and trademarks through successive enforcement and policing of corporate trademarks as well as defense strategies for companies defending against such corporations.
Lynda L. Calderone chairs Flaster Greenberg’s Intellectual Property Department. She serves a wide range of clients in U.S. and foreign patent prosecution, appeals before the Patent Trial and Appeal Board, U.S. reexamination and related PTO proceedings, and foreign opposition practice. Ms. Calderone concentrates her practice in the chemical, chemical engineering, mechanical and business method areas, and also manages clients’ patent and trademark portfolios.
Kristyne A. Bullock is a shareholder in the firm’s Intellectual Property Department. She concentrates her practice in patent procurement and transactional matters, patent litigation, and IP portfolio strategy and management. She conducts due diligence analyses for mergers and acquisitions and provides guidance and counseling to clients in patent law and interpretation, the implications of intellectual property law on business and commercial strategies, and licensing and IP-related agreements.
