Alexis Arena Named a 2019 Pennsylvania Trailblazer by The Legal Intelligencer

Alexis Arena, shareholder in the Intellectual Property and Litigation Departments at Flaster Greenberg, has been named by the Legal Intelligencer to their 2019 Pennsylvania Trailblazers list. Alexis is one of 26 attorneys in Pennsylvania selected for this prestigious list, which identifies those attorneys who are “truly agents of change” and “who have made significant marks on the practice, policy, and technological advancement of their practice.”

A trademark and copyright attorney, Alexis has been a trailblazer in the area of IP law in Pennsylvania and beyond. She also is quickly making her mark at Flaster Greenberg, having not only been elected Shareholder in her mid-30s, but also by taking a leadership role in various committees, including the firm’s Diversity Committee and Women’s Initiative Committee. She also spearheaded the firm’s Internet Disputes practice, successfully representing companies in online reputation matters and in defending against removal from Internet search results. Outside the firm, Alexis serves on the Philadelphia Diversity Law Group Board of Directors.

One of Alexis’s recent legal successes includes a precedential decision for her client in the Third Circuit Court of Appeals in a copyright infringement lawsuit, where her client, a Halloween costume manufacturer, claimed that a competitor copied the design of his banana costume and then wrongfully sold the “look-alike” costume. In 2018, Alexis obtained an initial favorable ruling, which restrained the defendant from marketing, advertising, or selling the banana costume design. The defendant appealed, and Alexis argued again in Appellate Court in April 2019, where her arguments resulted in the Judge affirming and granting the preliminary injunction in favor of her client. Although the defendant’s counter argument claimed that one cannot copyright the overall look of a banana, which was a unique and challenging argument for any attorney to overcome, the judge sided with Alexis on the distinctiveness of the “individual components that come together to create the banana costume.”

Alexis has been named to the World Trademark Review 1000 list for the last four consecutive years, a 'Lawyer on the Fast Track' by The Legal Intelligencer, a Pennsylvania 'Rising Star' by Thomson Reuters, publishers of Super Lawyers magazine, an ‘Awesome Attorney’ by South Jersey Magazine and a 'Top Attorney' by SJ Magazine.
