Rachel E. Licausi is a member of the Litigation Department. She maintains a broadly-based practice focused on commercial litigation and represents corporate entities, government entities, and individuals involving a range of industries. She practices regularly in state and federal courts in both Pennsylvania and New Jersey and has been named a New Jersey Rising Star by the publishers of New Jersey Super Lawyers for the last three years. Additionally, Ms. Licausi has guided clients through the mediation and arbitration processes in lieu of litigation. Ms. Licausi has also been a pro bono civil rights advocate and recently obtained a favorable settlement for a pro bono client.

Ms. Licausi is also a member of the Family Law Department representing clients in matters involving divorce, alimony, child support, child custody, parenting time, division of assets and debt, prenuptial agreements and adoptions. She has successfully represented clients in complex matrimonial matters involving substantial marital estates and business valuations. Ms. Licausi and the family law department are also at the forefront of family formation law where they guide clients through the legal issues involved in surrogacy, gestational carriers, and sperm and egg donation arrangements.

Prior to joining Flaster/Greenberg in 2007, Ms. Licausi served as a summer associate in the Legal Affairs department of MetLife, Inc. in Rhode Island.

Representative Matters

  • Defense counsel (2nd chair) in federal case filed by a participant in the Housing Choice Voucher Program.  Plaintiff’s claims were brought under 42 U.S.C. § 1983, for a purported “state created danger”, violations of the 5th and 14th Amendments, the United States Housing Act, and regulations implemented by HUD pursuant to the Housing Act – Including the Housing Quality Standards.  Responsible for Daubert briefing, all pre-trial preparation, selection of a jury and assisted in settlement negotiations
  • Represented a New Jersey doctor in litigation against a local hospital and other physicians for deprivation of the doctor’s rights under the hospital’s bylaws
  • Represented party in estate litigation against defendant who was removed as executor after failing to make distributions and sell estate properties

  • Successfully advocated to defeat motion for summary judgment and obtain favorable settlement amount for pro bono client asserting civil rights claims in New Jersey federal court
