Lynda L. Calderone

Lynda L. Calderone is chair of the firm's Intellectual Property Department. She has extensive experience in the preparation and prosecution of U.S. patent applications as well as intellectual property litigation. A founding shareholder and chair of the Intellectual Property Practice Group at Flaster/Greenberg, Ms. Calderone serves a wide range of clients in U.S. and foreign patent prosecution, appeals before the Board of Patent Appeals and Interferences, U.S. reexamination and interference practice and European opposition practice.

Ms. Calderone concentrates her practice in the chemical, chemical engineering, mechanical and business method areas. Her primary technical areas of patent practice include chemical process technology; petrochemicals; catalysis; polymers; reinforced polymer composites; polymer fillers and polymer composite wear systems; medical devices; drug delivery systems; controlled and sustained release polymer mechanisms; hydrogels; nanotechnology; molecular sieves; fiber optics; metals and alloys; thermal gas recovery processes; semiconductor-related technologies; optical coatings; cosmetic and healthcare formulations; pharmaceutical processing; business methods and fuel cells. Furthermore, as a member of the firm’s Alternative and Renewable Energy group, she represents clients engaged in or considering business ventures in emerging green energy fields such as solar, wind, geothermal, cogeneration, biofuels and biomass.

Ms. Calderone has experience in patent due diligence; various IP related agreements, including licenses; and patentability, validity, infringement and unenforceability analyses. She counsels inventors and businesses in portfolio management and development of patent strategies, including conducting IP audits. Between 2001 and 2011, Ms. Calderone served as a Certified Mediator for the U.S. District Court for the District of New Jersey.

Ms. Calderone is also a seasoned intellectual property litigator with trial experience. She has successfully litigated intellectual property cases as well as prepared and prosecuted U.S. patent applications. She is also a court-appointed mediator for the United States District Court for the District of New Jersey.

An avid and popular speaker, especially at educational forums for students, in 2009 Ms. Calderone participated in Rutgers University’s 22nd Annual Guest Professor Program, where she presented a lecture on general intellectual property law and its impact on business decisions, to the undergraduate business law students. She also was the invited speaker who addressed students of the Technology Management graduate program at Stevens Institute of Technology in Hoboken, New Jersey, where she presented a lecture about how intellectual property can affect the life cycle of technology development.

  • Utility patent infringement action involving catheters used for hemodialysis for a medical device manufacturer
  • Utility patent infringement action in the area of bioremediation devices used in removal of oil from bilge water for a patentee manufacturer
  • Utility patent infringement indemnification action involving component parts for industrial appliances for a third-party defendant supplier
  • Settlement of infringement action pre-discovery on the part of a defendant in a multiparty litigation involving medical insurance billing software
