Kenneth S. Goodkind counsels clients in complex commercial disputes and all facets of debtor-creditor relationships as well as in trust and estates matters. He is highly skilled in resolving difficult litigation matters involving complex business, real estate and development, trusts and estates, debtor-creditor and bankruptcy matters, as well as healthcare issues.
A trial and appellate attorney, Mr. Goodkind handles a wide range of litigation matters in state and federal courts, representing a broad spectrum of individuals, entrepreneurs, professional and corporate clients. A former in-house counsel with a large multinational corporation, his practice also involves all aspects of general corporate, as well as personal, counseling.
Representative Matters
- Obtained injunctive relief preventing competitor from using his client’s marketing materials and hiring away employees; followed by judgment of almost $2 million, including attorneys’ fees, for subsequent violations of injunction
- Obtained $27 million judgment in less than 2 months for a major bank against a car dealer that failed to turn over sales proceeds and overdrew a line of credit
- Successfully represented a real estate developer in opposing governmental takeover of a redevelopment project, including prevailing in proving violations of government ethics laws by elected officials, saving client millions of dollars in development costs
- Successfully obtained specific performance of purchase contract for large, multi-million dollar, unique residential real estate project, prevailing in litigation in the trial court, the Appellate Division and the Supreme Court
- Successfully appealed consumer product class action certification to Supreme Court
- Settled vehicle sales consumer class action without protracted litigation or costs for client
- Successfully defended a major real estate developer in litigation brought by former shareholders seeking multi-million dollar award under minority shareholder oppression statute
- Obtained injunctive relief in the Appellate Division in two months against a major landlord’s eviction of a client, saving the client the cost of a full appeal
- Obtained emergency injunctive relief against the former owner and employees of an international sales company to prevent unfair competition, leading to favorable financial settlement for the client
- Defeated multiple attempts by an overzealous vendor to collect tenant’s debt from his client, the landlord, including recovering legal fees for the client
