Counsel

Bryna Silver Scott, counsel in the Intellectual Property Practice Group, focuses her practice on all aspects of trademark, unfair competition, copyright and Internet law. She has extensive experience in United States trademark practice, including enforcing and defending trademark rights and conducting opposition and cancellation proceedings before the United States Trademark Trial and Appeal Board. She assists clients with regard to policing and quashing trademark infringement by cybersquatters on the Internet, transactional issues relating to e-commerce and advising on extension of copyright protection to the Internet arena.

Ms. Scott has initiated and supervised many international trademark programs. She has worked very closely with foreign associates in filing and prosecuting trademark applications, renewing trademark registrations and bringing and defending infringement actions. She has also negotiated and prepared technology transfer, co-existence, license, consent, assignment and confidentiality agreements on an international basis.

Prior to joining Flaster/Greenberg, Ms. Scott had been a partner for 14 years at the former intellectual property boutique Synnestvedt & Lechner LLP. A longstanding leader in the legal community, she is an active member of the International Trademark Association and has been a member of its International Editorial Board and Government Relations and Meetings Committees. She also has served as chair of the Philadelphia Intellectual Property Law Association's Trademarks and Unfair Competition Committee. Ms. Scott has been a lecturer at seminars, such as “Evolution of Federal-Anti-Dilution Act” before the Philadelphia Intellectual Property Association. She presented an update on the U.S. Trademark Trial and Appeal Board Practice at an annual meeting of the International Trademark Association.

Ms. Scott represents public and private companies in such industries as graphics production; musical instruments; consumer and trade publications and professional journals; environmental protection products; professional services; food; consumer products and services; apparel; jewelry; and software, handling such matters as:

  • Advising companies regarding brand selection and the expansion and strengthening of their portfolios of intellectual property through registration, licensing, and other means
  • Assisting foreign counsel that require IP protection for their clients in the U.S.
  • Contested matters in the U.S. Patent and Trademark Office
  • International procurement and protection of intellectual property rights
  • Prosecution of cyber squatters on the Internet
  • Prosecution and defense of copyright infringement matters
