Court ruling may make it tougher for lenders to foreclose

The groundbreaking decision against the Bank of New York in a foreclosure action was reported by NJBiz and extensively quoted Eric Garrabrant, attorney for one of the borrowers. Stated Garrabrant, “The ruling means that the party bringing suit must establish – with a definiteness never before articulated by New Jersey courts – that the borrower owes the money to the party filing the lawsuit on the date they file suit.”
